Do Kwon Should be Extradited to South Korea, not United States, Lawyer Argues

Kwon’s attorney has argued that the co-founder of Terraform Labs should be extradited to South Korea instead of the United States. This statement comes in response to extradition requests from both countries, with Kwon currently detained in Montenegro.

Goran Rodic, Kwon’s Montenegrin legal representative, has contended that, in accordance with the European Convention on the Extradition of Criminals, the bilateral agreement with the United States, and domestic laws governing international legal cooperation, Kwon’s extradition should be directed to South Korea.

Rodic, speaking to the local newspaper Poveda, emphasized that Do Kwon is a Korean citizen, and he holds absolute confidence that repatriation to South Korea is the appropriate course of action.

Political Motivations Maybe a Factor in Do Kwon’s Extradition

The situation is further complicated by political factors, as Montenegro’s Justice Minister, Andrej Milovic, alluded to the possibility of political considerations playing a role in the extradition process.

During a November interview with a local broadcast, Minister Milovic referred to the United States as Montenegro’s “most significant foreign policy partner.” This has sparked concerns about whether political considerations might sway the ultimate decision regarding the destination of Terra’s founder.

In December of the previous year, the U.S. Wall Street Journal reported that Minister Milovic had announced intentions to extradite Kwon to the United States, directly informing the U.S. Ambassador to Montenegro of these plans.

U.S. Trial Moved to Mid-March

Recent developments, including the postponement of the trial date in the U.S. federal court, have given rise to speculation regarding potential underlying motivations. Originally slated for the 29th of this month, the trial has been rescheduled to March 25th, causing major international media outlets to scrutinize the decision within the context of Kwon’s potential extradition to the United States. Kwon’s American attorney had argued for the trial delay, citing Kwon’s need to attend.

In response to these media reports, Lawyer Rodic dismissed them as deliberate attempts to apply pressure, asserting, “It is not coincidental that these media reports are surfacing at this juncture.”

Currently, Kwon’s legal team has appealed the Podgorica High Court’s decision in Montenegro. Nevertheless, local reports indicate that the ultimate verdict on extradition will rest with Montenegro’s Justice Minister.
